In gently pre-owned condition (does have some yellowing inside shoe see pic)
As to why I list the items as new with defects is for the fact there can be slight defects via small blemishes like scuffs on the bottom or sides of the shoe. I would feel like it's dishonest to the customer to list them as new even though some might still have the original tags on them.
I try to take the best pictures I can to help the customer see if there are any defects or issues with the shoes. Also, defects are subjective depending on the person.
